PrivateEquityCareer.com LLC (“PEC” or “we”) is the developer and owner of the LPAllocator site, a web based news and information service, which includes, without limitation, all associated computer software, functionality, features, media, printed materials, and “online” or electronic documentation (collectively, the “LPAllocator Site”). The LPAllocator Site is available through the website at https://www.privateequitycareernews.com. PEC provides to its clients and their users (individually, a “Client” and collectively, “Clients”) the right to use the LPAllocator Site pursuant to your agreement with PEC and the LPAllocator Site Terms of Use (“Terms”) entered into by and between PEC and Clients. Please review our Terms, which governs your use of the LPAllocator Site and any content you submit to the LPAllocator Site.

Your privacy is important to PEC. As part of your use of the PEC Site, personal data is gathered about you (individually, a “User” and collectively, “User”). This Privacy Policy contains explanations regarding the types of information collected, how that information may be used or disclosed, and how to correct or change the information.

By using the LPAllocator Site you will be required to provide PEC certain personal data in accordance with this Privacy Policy. This data includes: (a) first and last name, (b) email address (collectively, “Personal Data”). PEC undertakes efforts to protect the confidentiality of the Personal Data and other information it has collected about individual Clients and Users, and except as otherwise set forth in this Privacy Policy including, without limitation, under the heading Limits of Confidentiality, will not intentionally disclose this information to anyone outside PEC.

Except as otherwise set forth in this Privacy Policy, we restrict access to your Personal Data to employees, subcontractors, or business partners who need to know that information in order to perform their jobs or duties and provide services to you.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your personal information transmitted to the LPAllocator Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the LPAllocator Site.

PEC will assist any User who informs us that they need assistance in preparing a request concerning Personal Data. You may also request to have your Personal Data amended as appropriate, or request that PEC delete or correct any of your Personal Data.

Limits of Confidentiality:

By using the PEC Portal and sharing your Personal Data with us, you will have opted-in to our collection, disclosure and use of your Personal Data and any non-Personal Data under this Privacy Policy.

We may use your Personal Data for the purposes of sending you registration and authentication information for the LPAllocator Site, maintaining your account, processing your requests, providing you with information, metrics and other services, processing your communications, and communicating with you by email and phone about the LPAllocator Site, PEC, and other related services. We may also use Personal Data for auditing, research and analysis to operate and improve PEC’s technologies, systems, and services.

We do not sell any of your Personal Data (including your name, email, or phone number) to any companies or third parties, nor will we sell your Personal Data except in a sale or transfer of our business pursuant to subsection (iii) below. We also do not share any of your Personal Data with unaffiliated or non-agent third parties for the purpose of marketing or promoting our products or services to you.

Further, when you send email communications to PEC, we may retain those communications in order to process your inquiries, respond to your requests and improve our services.

(i)  Affiliated or Third Party Businesses. We may provide your Personal Data to our subsidiaries, affiliated companies, or other trusted businesses or persons (“Affiliated or Third Party Businesses”) for the purpose of processing or storing Personal Data on our behalf. These Affiliated or Third Party Businesses include, without limitation, third parties we use to assist us in our mission of providing you with the LPAllocator Site such as data center hosting providers. The Personal Data that we process or that is processed for us may be transmitted to and stored on the servers of Affiliated or Third Party Businesses. When we do disclose your information to others, it is subject to agreements that require those parties to process such information in compliance with this Privacy Policy, and in an appropriate confidential and secure manner.

(ii)  Security and Legal Obligations. Due to the existing legal, regulatory and security environment, PEC may disclose aggregate level and/or Personal Data about its Clients and Users to protect the rights, property or safety of PEC, or the public, to prevent fraud or imminent harm, and in connection with providing for the security of our computer systems, computer network, telecommunications network, products and services. PEC also may use and disclose your Personal Data: (1) to the extent required to respond to a legal or ethical obligation, (2) to the extent necessary to meet national security, public interest or law enforcement obligations, and (3) to the extent expressly permitted by an applicable law, rule or regulation. Additionally, your Personal Data may be disclosed as required by applicable law, to comply with a court order, subpoena, warrant or other legal process, or where the personal data is publicly available (unless otherwise restricted by applicable law).

(iii)  Sale or Transfer of Business. We may sell or otherwise transfer your Personal Data to a successor of PEC, or any subsidiary or division of PEC in connection with an asset sale, acquisition, merger, consolidation, divestiture, purchase of part or all of the assets of the business, or other corporate transaction, or by way of assignment (whether by operation of law or otherwise) in connection with any such or similar transaction or in connection with the administration of a bankruptcy estate. In the case of such event, PEC’s systems, technology, intellectual property, and data, including Personal Data, will become the property of the successor and will be subject to the successor’s Privacy Policy should they have one.

PEC is committed to protecting the privacy of minors. Our policy is that we do not knowingly collect, use or disclose Personal Data about Clients or other users that we know are under 18 years of age. This LPAllocator Site is not directed in any respect to anyone under the age of 18. If we learn that we have collected or received personal information from an individual under the age of 18 without verification of parental consent, we will delete that information. BY SUBMITTING YOUR PERSONAL DATA TO PEC, YOU HEREBY CONSENT TO PEC’S COLLECTION, USE AND DISCLOSURE OF SUCH INFORMATION. IF YOU DO NOT CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA AS DESCRIBED IN THIS PRIVACY POLICY, YOU SHALL NOT SUBMIT SUCH INFORMATION TO PEC.
